A board at the owner is not a pass at the White House

The same week the Paramount–WBD consent decree invented an Editorial Independence Board for CNN and CBS News, the White House tried to put CNN out of the building.

On 18 September 2026 President Trump announced a ban on CNN, MS NOW, and Politico from White House grounds over coverage he called fake or negative. The outlets sued on 21 September. U.S. District Judge Timothy Kelly — who had restored a CNN reporter’s pass in a first-term fight — ordered the credentials returned on 24 September, at least for two weeks. He called the government’s standard vague, doubted the national-security story, and said due process required more than a dislike of the coverage.

That case is about the state. The five-person board is about the owner. Mixing them is how a merger remedy gets advertised as press freedom.

An owner-appointed panel can, on paper, hear a CNN or CBS employee who says management changed a piece to please the holding company. It cannot restore a hard pass. It cannot put a camera on the lawn. It cannot make the president take a question. Judge Kelly can. A later court might not. Either way, the docket is the Constitution and the gate log, not a compliance officer.

CNN sat in both stories at once: a newsroom the Ellison company is buying, and a newsroom the White House tried to lock out. A board that reports through the combined company’s compliance line does not answer the second problem. If anything, a quieter CNN that fears both the owner and the gate would look “stable” to a corporate board and look captured to a reader.

Other outlets signed a Committee to Protect Journalists statement the same week: no news organization should be punished by the government for reporting. That sentence is the access fight. It is not the decree. Bonta’s line about objective reporting at CBS and CNN is the decree. They can both be true and still not be one instrument.

What this desk will not do is pretend the TRO settled the year. Kelly’s order was temporary. The administration can try again. The board, if it ever sits, can ignore a ban it cannot touch. Two clocks, two defendants.
